Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Spokt iOS application and related services (the "Service") provided by Spokt ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the Service. By using the Service you confirm that you meet that requirement and that you have the right to enter into these Terms.

2. Your account

You sign in with Apple or Google. You're responsible for the activity on your account and for keeping your sign-in credentials safe. If you suspect unauthorized access, contact myyno97@gmail.com immediately.

You can delete your account at any time from the app's Settings → Delete Account. Deletion removes your account information and your stored content within 30 days.

3. What Spokt does

Spokt converts the documents, URLs, or text you provide into audio you can listen to and read along with. You give us the input; we run it through speech-synthesis and word-alignment pipelines and store the result in your library. You can import audiobooks you already own from your device for word-synced listening.

4. Your content, your rights

You retain all rights to any content you upload or import into Spokt. By using the Service you grant us a non-exclusive, worldwide, royalty-free licence to host, process, transmit, and display your content solely for the purpose of operating the Service for you. We don't claim ownership and we don't use your content to train AI models.

You're responsible for ensuring you have the right to upload the content you submit. Don't upload anything that infringes someone else's intellectual-property rights, violates privacy or publicity rights, or is illegal in your jurisdiction.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or to upload content that violates these Terms.
• Bypass, disable, or interfere with security or rate-limiting features.
• Reverse-engineer, decompile, or scrape the Service except as expressly permitted by law.
• Use the Service to generate or distribute spam, malware, harassment, or hateful content.
• Upload audiobooks you don't own or are not licensed to use. DRM-protected files (e.g. Audible downloads) are explicitly not supported.

6. Subscriptions, credits, and payments

Spokt offers a free tier, monthly/annual subscriptions, a one-time Lifetime plan, and consumable credit packs for additional generation capacity. All purchases are processed through Apple's App Store using Apple's billing system.

• Auto-renew: Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before renewal. Renewal charges are billed to your Apple ID.
• Managing subscriptions: Open iOS Settings → your Apple ID → Subscriptions to change, pause, or cancel.
• Refunds: Refund requests must be made directly to Apple via reportaproblem.apple.com. We do not have access to refund your payment.
• Credits: Credits are non-refundable, non-transferable, and have no cash value. Unused credits remain in your account as long as your account is active.
• Lifetime: "Lifetime" means the operational lifetime of the Service. We will give at least 90 days' notice if we ever discontinue Lifetime support.
• Free trials: Where offered, free trials convert to paid subscriptions automatically when the trial ends, unless you cancel before then.

7. Service availability

We aim to keep the Service running smoothly but we don't guarantee uninterrupted availability. We may suspend or stop parts of the Service for maintenance, upgrades, or for legal or security reasons. We'll give reasonable notice for any change that materially reduces functionality available to paying users.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We don't warrant that synthesized audio will be free of errors or that word-alignment will be perfect.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SPOKT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR USD 50, WHICHEVER IS GREATER.

10. Termination

You can stop using the Service at any time. We can suspend or terminate your access if you breach these Terms, or if required by law. On termination, your right to use the Service ends, but sections of these Terms that by their nature should survive (e.g. content licence for content already on the Service, disclaimers, limitation of liability) will survive.

11. Changes to these Terms

We may update these Terms from time to time. If a change is material we'll notify you in-app or by email at least 30 days before it takes effect. Continued use after the effective date is your acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Spokt is incorporated, without regard to its conflict-of-laws rules. Any dispute will be resolved in the competent courts of that jurisdiction, unless a non-waivable consumer-protection law in your country of residence gives you the right to sue locally.

13. Apple-specific terms

You acknowledge that these Terms are between you and Spokt, not Apple, and that Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. In the event of a third-party claim that the Service or your possession and use of it infringes intellectual-property rights, Spokt — not Apple — will be solely responsible for investigating and resolving the claim. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them as such.
